Customer Terms & Conditions

These Terms & Conditions apply to all quotations, consultations, orders and work carried out by Marlin Marine Interiors.

By accepting a quotation or instructing us to proceed with work, you agree to these Terms & Conditions.

 

1. About Us

Marlin Marine Interiors provides marine interior refurbishment, bespoke joinery, upholstery, restoration and associated services for sailing yachts and motorboats throughout Devon & Cornwall.

 

2. Quotations

All quotations are provided free of charge unless otherwise stated.

Quotations remain valid for 30 days from the date issued unless otherwise specified.

Following an onboard inspection, quotations may be amended if previously unseen issues are discovered.

Any quotation is based on the information available at the time of preparation.

 

3. Acceptance of Quotation

Work will only be scheduled once:

  • The quotation has been accepted in writing.

  • The required deposit has been received.

 

4. Materials Deposit

Where necessary, a 60% deposit is required before materials are ordered and work is scheduled.

This deposit allows us to:

  • Purchase materials specifically for your project.

  • Reserve workshop and installation time.

  • Commit resources to your refurbishment.

Materials ordered specifically for your project cannot usually be returned.

 

5. Balance Payment

Unless otherwise agreed in writing:

The remaining balance is payable immediately upon completion of the work and before the vessel is released or final handover takes place.

Invoices are payable within 7 days.

Late payments may incur statutory interest and reasonable recovery costs where permitted by law.

 

6. Changes to the Project

Many refurbishment projects evolve once work begins.

If additional work is requested or unforeseen repairs become necessary, we will:

  • Discuss the additional work with you.

  • Explain any additional costs.

  • Obtain your approval before proceeding wherever reasonably practical.

 

7. Hidden Defects

Marine refurbishment often reveals hidden issues which were not visible during the original inspection.

Examples include:

  • Rotten timber

  • Water ingress

  • Hidden structural damage

  • Previous poor-quality repairs

  • Electrical faults

  • Corrosion

Where these issues affect the project, additional work may be recommended and separately quoted.

 

8. Customer Responsibilities

The customer is responsible for:

Providing reasonable access to the vessel.

Removing personal belongings where requested.

Ensuring the vessel is safe to work on.

Providing electricity or water where reasonably available.

Obtaining any marina permissions required.

 

9. Delays Beyond Our Control

Completion dates are estimates only.

Projects may occasionally be delayed by circumstances outside our control including:

  • Weather

  • Marina restrictions

  • Supplier delays

  • Material shortages

  • Illness

  • Hidden defects discovered during work

Where delays occur we will keep you informed.

 

10. Materials

Natural materials such as timber, leather and fabrics may vary slightly in:

  • Colour

  • Grain

  • Texture

  • Finish

These variations are considered normal and form part of the character of natural materials.

 

11. Customer-Supplied Materials

Where customers supply their own materials:

We cannot guarantee their suitability, durability or compatibility.

Any additional labour arising from customer-supplied materials may be chargeable.

 

12. Photographs

We may photograph completed projects for:

  • Our portfolio

  • Website

  • Social media

  • Marketing

No personal information will be published.

If you would prefer your project not to appear in our portfolio, please let us know before work begins.

 

13. Warranty

We stand behind the quality of our workmanship.

Our workmanship is covered for 12 months from the completion date against defects arising from installation or craftsmanship.

This warranty does not cover:

  • Normal wear and tear

  • Accidental damage

  • Misuse

  • Water ingress unrelated to our work

  • Damage caused by third parties

  • Lack of maintenance

Manufacturer warranties apply to supplied products where applicable.

 

14. Cancellations

If the customer cancels before materials have been ordered, the deposit may be refunded, less any reasonable costs already incurred.

Once materials have been ordered specifically for your project, those material costs are non-refundable.

If work has already begun, payment will be required for:

  • Labour completed

  • Materials purchased

  • Any other reasonable costs incurred

 

15. Limitation of Liability

Our liability is limited to the value of the work carried out.

We are not responsible for:

  • Existing defects

  • Previous repairs

  • Hidden structural issues

  • Loss of use of the vessel

  • Indirect or consequential losses, except where liability cannot legally be excluded

Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot legally be excluded.

 

16. Force Majeure

We shall not be liable for delays or failure to perform our obligations due to events beyond our reasonable control, including but not limited to severe weather, fire, flood, industrial disputes, government restrictions or supply chain disruptions.

 

17. Complaints

If you are unhappy with any aspect of our work, please contact us as soon as possible.

We are committed to resolving concerns fairly and professionally.
